By accessing or using Obvela ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

OBVELA is an AI-powered cold email generation platform that uses dual AI technology to create professional, human-like emails with 0% AI detection rates. The Service offers both free and paid subscription tiers.

We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

3. Account Registration

By creating an account, you:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Agree to receive service-related communications
  • Can delete your account at any time from account settings

4. Subscriptions and Payments

OBVELA offers the following subscription plans:

  • Free Plan: 10 emails per month with basic features
  • Pro Plan: €29/month for 100 emails per month with premium features

By subscribing to a paid plan:

  • You authorize us to charge your payment method monthly
  • Subscriptions automatically renew unless cancelled
  • You can cancel anytime from your account settings
  • Cancellations take effect at the end of the current billing period
  • We offer a 7-day money-back guarantee for new subscribers
  • No refunds for partial months or unused credits

5. Acceptable Use

You agree NOT to use the Service to:

  • Violate any applicable laws or regulations
  • Send spam, phishing emails, or malicious content
  • Harass, abuse, or harm others
  • Impersonate any person or entity
  • Distribute malware or harmful code
  • Infringe on intellectual property rights
  • Engage in fraudulent activities
  • Reverse engineer or attempt to extract source code

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Obvela and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks, logos, and service marks may not be used without our prior written permission.

7. User Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account (when launched)
  • All activities that occur under your account
  • Ensuring your use of the Service complies with applicable laws
  • The content of emails you generate using our Service

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Uninterrupted or error-free operation

We do not warrant that the Service will meet your requirements or that it will be secure, accurate, or reliable.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OBVELA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or use
  • Business interruption
  • Loss of goodwill
  • Any other intangible losses

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Obvela, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you generate using the Service

11. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand our data practices.

12. Termination

We reserve the right to terminate or suspend your access to the Service immediately, without prior notice, for any reason, including:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Extended period of inactivity
  • At our sole discretion

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by:

  • Posting the new Terms on this page
  • Updating the "Last Updated" date
  • Sending an email notification (for significant changes)

Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Lithuania, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved in the courts of Lithuania.

15. Dispute Resolution

In the event of any dispute, you agree to first contact us at hello@obvela.com to attempt to resolve the issue informally.

If we cannot resolve the dispute within 30 days, either party may pursue formal legal proceedings.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Obvela regarding the Service and supersede all prior agreements and understandings.
